Blackberries and data plans, AT&T?

Ok so I want to buy a blackberry from a friend of mine, instead of through at&t. My question is if I buy that phone and just put my sim card in and at&t sees that im using a blackberry, will they force a data plan on me?

I know they force the data plan now with phones bought through them, but I can't find anything regarding phones bought elsewhere, like ebay, craigslist, what have you.

    AT&T requires the data plan on all smart phones regardless of where purchased. When the system detects that you're using a smart phone, it will automatically add the data plan to your bill.

    AT&T and Verizon have had too many customers "inadvertently" run up thousands of dollars in data charges that the carriers were expected to waive. This policy ensures that doesn't happen.

    If they see you are using a blackberry, then yes, they will force a blackberry plan on you. The data plans for smartphones like Blackberries and iPhones are required regardless. Unfortunately that's the way things are nowadays for all the big cell phone companies.
