Do i have a case for a lawsuit?
I was 7 weeks pregnate and heard the heartbeat the baby was perfectly healthy i got a bad toothache at 9 weeks and went to the ER for the pain the Doctor prescribed Vicodin for the pain i took 2-3 and told him at the time i was 9 weeks pregnate and he said it was perfectly fine. I took the medicine . Well i went back for the 2ed ultrasound at 12 weeks and they said by determining the size of the baby the babys heart stopped beating at 9 weeks within the same 2-3 sayd i took the vicodin . MY ob said that it was very unusual to have a regular miscarriage after hearing the heartbeat. Therfore my body didnt even axually want to "pass" the baby and have the miscarriage until 15 weeks. Can i sue this doctor for malpractice for giving me a medicine that is suppose to be a Class C narcotic and danger to take during pregnancy. Do i have a good chance to sue. I know alot of these lawyers will tkae the case and say if you dont win you wont get any money so thats not the issue . But what do you think . Can i sue him for this ?

First off, my heart goes out to you for your loss. Don't even try to sue unless you want them to look into every aspect of your life. Did you smoke a cigarette? Have an alcoholic beverage? Around somebody who smoked? Eat too many calories?...etc... Two or three vicodin will very rarely cause a miscarriage, there was something else going on. You ob is very interesting in the fact he/she told you it was unusual to lose a baby after hearing the heartbeat- it happens all the time. Do not try to sue. It's a waste of time. Money isn't "free".

Sure you can sue, however the burden of proof is on you to prove that the Vicodin caused the miscarriage.
A couple of articles I have found so far do not indicate a link. Perhaps the massive infection you had was the cause?

The articles all discuss issues that can happen if you abuse the drug or take it for a very long time. That does not seem to apply here.
To win you will need a doctor that is willing to state that the Vicodin caused the miscarriage.

Well you could. You may or may not win. Sorry for the loss of your child though. I would say sue to at least try to put a bad mark on his record so something like this won't happen again.
