okay this is for anyone who knows tenant laws?
okay so in my buliding there is someone who is smoking all the time it's starting to come into my apartment.... i have astma and i can't breathe at night or when i get into my house. And it's starting to stink up my place and my stuff!!! i don't think that is very cool!!! is there anything i can do or say to put a stop to this???

State laws vary quite a bit, so it may depend on what state you live in.
You may have a claim for what in law is called a breach of quiet enjoyment. You should start by asking the tenant if he can smoke using a smoke-eating ashtray and a fan to blow the smoky air outside.
If that doesn't work, you can ask the landlord to stop the other tenant's actions breaching your quiet enjoyment. You may want to call your local board of health to come and inspect your apartment to be able to prove your claim about the smell and smoke in your apartment.

No there is not other than ask Landlord for another apartment. Unless this building is non smoking he has right to smoke

Apartments have separate ventilation systems. Question is, how is the smoke entering your apartment?

I would contact your landlord and see if smoking is even allowed, then go from there.
