car accident at fault no insurance?

my car was hit from behind last week and the insurance companies came to the resolution that the people that hit us were at fault. they didnt have any insurance and the person driving my car didnt have insurance either. i still owe 6k on the car, how can i get the $ back or get rid of my car without going to small claims court?

    if you gave the person permission to drive your car, most insurance companies will cover that person driving your car.

    However, what you are saying doesn't make sense. You are saying there are no insurance companies involved, on one hand -- you say the person driving didn't have insurance and the person who hit them didn't either -- but then you say the "insurances companies came to the resolution." What insurance company came to this resolution if no one is insured?

    If the person that hit your car didn't have insurance they should be going to jail or at least facing civil charges, which opens the way for you to sue them outright. Of course then you need a laywer, so be careful, but if you want to get your 5K (5K limit usually) in small claims, I think you'd have a pretty good case. Your insurance isn't supposed to cover it if the other person is at fault, unless you are in a no-fault state. Collision could cover some of it, but why should your insurance company pay?

    If your car is insured with collision coverage, that will cover the damages. If the vehicle is totaled, the settlement will go towards paying the loan. If the settlement is less than 6000, you'll be on the hook for the balance. Your insurance company will then pursue the other party for the reimbursement of your deductible, after they've finished paying out on the claim. It doesn't matter that the driver of your vehicle isn't insured. It's the car that's insured. Since you're paying a loan, you should be carrying collision coverage on it.

    well my wife got rear ended by a mexican with no insurance, Our insurance didn't cover it either.

    So we ended up having to take them to civil claims court and sue them out of house and home,

    Funny part is..3 months later she tried to claim she had a neck injury and tried to sue us back.

    hahahahahhahhaahahhahahahhahahahha

    That didn't work out for them.

    Anyways, They'll be paying off our 6,500$ Toyota for the next 15 years or goto prison....and still have to pay it when they get out.

    Nothing.

    sell the car.

    Your insurance is not covering that person who drove your car.

    that's y you dont let no one drive your car unless they are insured with you.

    it's a win win situation.
