In Virginia is a wife required to testify against her husband?

D.A. subpoenaed my wife and said she had to testify against me on an assault issue. Married 23 years, and neither one of us want to press the issues. It was an assault issue on my part, and a fidelity issue on her part, the issue just got really out of hand. Now the state of Virginia says she has to testify against me on the assault, and neither one of us wants to bring the issues up. Advise???

    a subpoena means that she would have to answer the DAs questions or go to jail for contempt of court. There is a such a thing called privileged relationships like doctor patient client and attorney, and person and priest. There is also one called husband and wife. Not all states recognize these privileges. Ask your attorney if you can prevent her from testifying under the husband and wife privilege. But in your case she was the victim so she would probably have to. Both of you should consult an attorney. And you should stop assaulting your wife and seek help.

    If your wife has received a subpoena, she needs an attorney.

    An attorney will see you for free for a consult.

    Do not make assumptions or take advice from people who are not attorneys.

    Also, do not seek advice from or take the advice of the DA.
