Can a cop give you a ticket if he/she never sees the key in the ignition according to Arizona State Law?
I had a friend tell me that if you were to get pulled over, all that you would have to do is take out the key, even if you just set it on the seat next to you, and even if there is no one else in the car or anything the cop cannot give you a ticket because he/she did not see the key in the ignition. I want to know if this is actually true before I risk pissing off a cop if I ever get pulled over! And this doesn't apply to DUI's, I know, I'm talking about speeding tickets mostly.
I agree it sounds ridiculous, hence the skepticism, but there are also laws prohibiting donkeys sleeping in bathtubs in AZ. Our government is capable of obscene stupidity, so I thought it worth while to check it out.

Seriously, what would removing the key even do? Would it just be an attempt to prove you drove the car without a key or what?

That's like saying that once you stop the vehicle after it was speeding it is no longer speeding so you cannot cite him..... Makes no sense. A reasonable person will assume that the vehicle is operating on the street. Not to mention a seat belt violation in that state is a secondary offense, which means you have to be stopped for something along with seat belt anyway.
I can see cross examination of the officer on the stand now. haha

Was the defendant in the driver's seat?

J, they got joke answers because this is a joke question (or at least it should be). Your answer is a joke too. Of course anything can be legal with the right lawyer. Once charges are brought then anything goes. I would love to see a public defender try and use your defense.
Also, I am not a cop. Why would you assume we all are? If you have read any of my answers you would know that I am anything but a cop. Your foolish assumptions do harm to people like me who are actually trying to educate so that police reform can take place.

even although my opinion isn't the main ordinarily shared i've got faith the guidelines in Arizona are not racist. the undertaking with unlawful extraterrestrial beings in Arizona is extremely severe. The kidnap fee and homicide fee have dramatically bigger. Now if others states have that individual same difficulty then they could desire to handle it. i'm no longer announcing immigrants are undesirable because of fact they're a huge area of our monetary equipment and that they do no longer take jobs from every physique because of fact no one might do the roles they do yet there are criminals and that they could desire to be apprehended and deported.

Of course it isn't true. If the police catch you speeding, it doesn't matter if you take the key out of the ignition before he gets to your car. Your friend is either messing with you or is a moron.

Oh my god! You found our one weakness, I had prayed for years that this would not go public! Now I will never be able to write another ticket ever again because the public knows all they have to do is take the key out of the ignition............................................................................
Seriously, you should ask yourself if that even sounds like it might be true.
EDIT:
The pulling the keys out of the ignition and drinking advice is yet more bad advice on here. If you think that will keep you from getting a DWI then you shouldn't even drive sober. It is scary what people post on here and try to sell.

Short answer is no, this is not true. You might get out of a ticket if you try this on an AZ officer, he may be too busy laughing to write the citation.

Of COURSE it`s true , Eunice ! Next time you get stopped for speeding ........... pull over ........... remove the key ............ light up a cigarette ......... sit back ...... blow smoke in the officer`s face ............ and remind him of the "no key in the ignition" law .

Well in a law class we were told that is LEGAL in Connecticut, according to a law professor, even for DWIs... don't know much about the specifics... basically if you get the keys out AND THEN start drinking before the police reach your window, it prevents the investigation b/c they have no official proof of when you started drinking. So this only works b/c in Conn its legal to drink in your car as long as the keys aren't in the ignition. So oh well
