Quit my job because I haven't been paid in 3 months, can i collect unemployment?

I have no idea what to do from here. I work for a very small business( just him and I, and his daughter) and all was well until I stopped getting paid. He paid me weekly, and the number of weeks of getting unpaid were adding up quick. It's been about 4 months like this, except he's given me like 4 paychecks in those 4 months, so my unpaid wages are a total of 12 weeks. I am so new to all of this. He's for the most part a great guy, but then again, I want business to be business. Where to I go from here? Can I collect unemployment even though I quit(is there some exception for not getting paid in 3 months?) How do I get my actual paychecks from him? thanks for the advice!

Yeah, I was on payroll, in fact I did the payroll. We used quick books. All of my checks are printed, I'm just not allowed to have them!

    yes you can quit for non-payment of wages and be eligible for unemployment.

    quitting for non-payment is "good cause" to quit a job.

    you need to file for unemployment and you also need to file a wage claim with the state to get your back wages.

    If you worked enough hours & you were being paid on the books, you may qualify for unemployment (constructive termination). If you were working for cash & no UE taxes were taken out you are going to have a problem.

    It is best to ask questions before leaving the job since you should not have advised that you were quitting, but that you considered yourself terminated due to non payment of wages for 12 weeks.

    You need to file a complaint with the department of labor for non payment of hours worked. You will need to include this with your UE claim because the unpaid hours will not have been reported. You will need good records of exactly when you worked & what you were/were not paid for.

    Were you paid under the table (cash) or we're you given a pay roll check and had taxes taken out? As long as you were given payroll checks then yes, you should be able to collect unemployment. My fiance was working for a company, got laid of in July. He has a few odd jobs here and there so he did not need to file for unemployment immediately, but as winter came..he no longer had odd jobs so he filed for unemployment in October..and he was still eligible for it. And you can still receive unemployment benefits if you quit or you were fired. If your boss is not giving you your pay check..then there is a problem. There should be no reason for him not to pay you on a weekly or biweekly basis. I would definitely say something to him about it, demand your money! You worked for it. If there's a problem and he refuses to give them to you..then you'll probably have to settle it in court.

    You need to contact a lawyer to try and get these wages paid. If he ends up going out of business, your debt needs to be on the list so that the banks know that he owes you wages.
