Serious question! Can i be arrested for writing a bad check?
I live in California, I didint have money for materials I needed to buy (lumber), for a job i was soon to be payed for, or so i thought so. I decided to just write the check for $600 dollars, i had thought to pay them later when i was payed for the job, little did i know, my clients were planning on paying later than i expected. I was worried, months passed by and i couldnt get the amount of money to pay off the debt. I had recieved the first notice, but i was broke at that time. Today i got a letter saying i have to go to court, im afraid though, will i be arrested, or will i just have to pay, or can i still come to an agreement with the Lumber company?
This is the first time this ever happened to me, will that change the outcome of my case?
The letter is a criminal complaint, and was sent from a LA Police office.....

Can you? Yes. Will you? Unlikely. You are probably being sued civilly by the Lumber Company. They will asking for a judgment against you if you can't settle your debt. Under Ca law, a judge can order you to pay the amount owed + damages of up to 3 x the amount owed. If unable to settle the full amount, you have to set up a payment schedule.

You could be arrested, in fact that was an option for me to carry out when someone forged several of my checks (I ended up not pressing charges, don't know if it was wise, though.)
*The* most important thing in going to court is to be honest. And if you're truly sorry, let it show - but don't grovel.
It sounds like it's too late to come to an agreement with the lumber company, but it is possible the court will order restitution (plus give you a fine.)
As a first time offender, if your record is otherwise clean, the odds are you won't have to go to jail.
If you don't show for court, you will be arrested, I would think.

Don't worry about jail. It's civil matter and The Lumber Company is just trying to collect what is owed to them. If you received just a letter than I don't believe they they filed a claim yet and are giving you an opportunity to pay up without having to go to Small claims court. You would know if your were served with court documents which would require you to appear.
Settling with the Company on your own is my best suggestion. It costs money to sue people so if they can avoid it, they will.

It's possible, but it's unlikely that that will happen if this is the first time you've done it. Whatever you do, do NOT ignore the court notice. It will only make things worse. Get it worked out with the other party and hopefully you can come to an amicable solution.

You can but it's unlikely you will. It's illegal to write a hot check and the payee could have filed criminal charges. For some reason, they chose only to file a civil lawsuit.

usually the bank covers it with the overdraft protection. basically the bank paid for it and you owe the bank. they would have to take you to court to get it back. but they can bill you, send it to a collector, and put you on check system and you won't be able to get a checking account. your best bet would be to pay the bank $50 a paycheck tell its settled.

is this rush limbaugh?! You can be arrested but likely you will have to make restituion. You should have opened a charge account with them and you could have paid it out.

yes if you write a bad check and It goes to a bank they might arrest you if you dont pay
