if someone draws a celebrity from a picture on a magazine, is it a copyright violation?

I want to draw if someone who draws celebrities from published pictures can sell the drawings. Does it make a difference how similar it looks to the pic? e.g. A super realistic rendering vs. a stylized caricature.

Yes, it does make a difference if the drawing is an obvious copy of the photo. However, unless your use of the drawing makes you money somewhere or is otherwise published, I estimate the chances of the copyright owner pursuing the matter isn't strong.
