City Dog Ordinance Policy?
I have 7 shihtzu's. I am not a breeder just a lover of this wonderful breed. I have had them for 5 years. Well last September, my city changed the ordinance and now says you can only have 5 dogs. Animal control saw them all playing outside, made sure they were up to date on their rabies shots, and had adequate playing space. After all that checked out fine they are telling me I need to get rid of two. Does the grandfathering clause apply to this situation seeing that I had my babies before this law passed? I don't want to call and ask them because they were not very nice and would probably say no it does not apply. I stay in Texas.

This really pisses me off! It's not friggin rocket science to put in a provision that owners of more than the set amount of dogs must agree to unannounced wellness checks a couple times a year. Problem solved.
I'm not sure about whether this could be grandfathered or not, but if they say no, there's no reason a citizen couldn't appeal that. Your city government works for you, although they frequently need reminders of this. A local attorney should be able to at least guide you on this for low fee. And if that doesn't work, he might have other ideas. Some attorneys like working on this stuff. In fact, that might be a good way to find one - call nearby rescue groups, explain the situation, and ask if they have a low cost attorney they can recommend.
I'd fight this any way I could and I'd also find a way to file against the animal control person if they treated you badly. They can be as rude as they want with people mistreating pets, but they have no right to play nasty dictator with people taking care of them.

Look it up on-line on the city's site. Some places have a permit that you can apply for where you can keep more pets. Normally it is an annual fee you pay yearly. If no grandfathering, you may to contact a lawyer to see if you have any options besides removing 2 dogs.

You need to find out this information. Some counties have a grandfather clause and others don't. Being ignorant can definately get your dogs removed from your home. so get your head out of the sand.

"grandfathering" clauses generally apply to things like apartment leases.. not actual laws.

What you do is ignore animal control until they take you to court. Then you will find out for sure how the new law applies to you.
