Is it just me or is this California Driving Test Critical Error a bit ridiculous?

So I was doing great on my test, got 3 minor errors, but I had a critical error that was a dangerous manuever.

You know when you merge into a bike lane for a right turn? I looked in my mirror, but not over my shoulder, after driving 35 mph down that road for 300 yards or so.

Isn't that a little bit ridiculous? Keep in mind I've gone through drivers ed and done the lessons and everything and that was never told to me.

    No its not but to me even though this was not brought up to you its still your responsibility to read the drivers handbook and learn all of the rules of the roads...........
