At what point do i need to register my sole proprietor business name.?

I have a small business that I want to run as a name other than my own. Do I have to register a trade name before I start advertising or can I run with it for a while before I have to register it with the state secretary?

    It depends on the state you live in. Some states require sole proprietors to file "fictititious names" or a dba(doing business as) name with the state secretary of state. In some states it is not required but you probably want to do it to keep the name for yourself.

    To find your state google your state name and Secretary of State, I used mine - Ohio Secretary of State.

    Some states you do not file with the secretary of state but you must file with your local county, city or township.

    You also need to be sure to call your state and local governments to find out if you need a business license, resellers permit aka vendors license.

    registering your name with the county does not protect the name of your business in the way you might think. It's very important, because you need it in order to open up a banking account in the name of the business. BUT, if you want protection of your name in Commerce... you need to also acquire a trademark registration.

    If you are starting a business, one of the most important things you should do is make sure you are not infringing on anyone's name and protecting yourself with a trademark.

    Definitely register your name first!!

    If you advertise and start using an unregistered name, someone else can easily take it and begin using it as well and you won't be able to do anything about it!!

    All of your time and money would have been for nothing.

    It only costs about $30.

    Don't forget to get it printed in the local newspaper for 4 weeks otherwise it won't be legitimate. (costs about $60)

    You're supposed to register your trade name before you sell anything. This will help to make sure it's a unique trade name, and that you are permitted to make and sell that particular product, and that you will pay taxes on items that you sell. Yes, definitely before you start advertising.

    Not sure about this, but, with a sole proprietorship, you're liable for taxes and so on,under your own identification. Reason for the uncertainty is that I haven't checked for a few years, but I don't see the rules changing -sole proprietorships are NOT legal entities.
