if a court has a tentative order and the expert?

witness was the petitioners father in-law,unknown to the court and unknown to the respondent,is the order based on his "expert" testimony tainted?. The judge states he based his decision on the expert witnesses accounting.

    I would think so. The defendants lawyer needs to bring this issue to the judge.
