you have to downgrade. u can do that by googling 3.1.2 firmware download and then after its downloaded have your ipod plugged in and hold the shift key and hit restore and it should say if you want to downgrade so click yes but u will lose everything. after its finished you can jailbreak it. here is a link:

First of all, restore your iPod Touch to its factory settings.
It would be easier if I knew your iPod Touch specifications...
There's 3 different generations of iPod Touches. Each with its own unique way of jailbreaking (well, maybe not the 1st and 2nd generations, they're pretty much the same).
=====================
1st generation iPods are easy to identify. They appear to be more blocky, and they have a larger WiFi cover. Follow 2nd generation iPod instructions.
--------------------------------------…
2nd generation iPods can be identifyed by their serial number. Their serial numbers can be found either on the back on the iPod or in Settings->General->About
All you need is the last 3 digits of the serial number:
201 - 2nd Generation 8GB
203 - 2nd Generation 16GB
208 - 2nd Generation 32GB
--------------------------------------…
3rd Generation can be identified by their serial number, model number, and date of purchase.
75J - 3rd Generation 8GB
Model number can also be founded in Settings->General->About. All 3rd generation iPod Touches should have the model number beginning with "MC"
If you bought your iPod Touch on or after September 9, 2009, you have a 3rd generation iPod Touch
====================
Jailbreaking is a process of hacking into an iPod. All official iPod Touch firmwares all check for a signature in every single application. If the signature is corrupt or not found, the iPod Touch will NOT run the application at all. This is more of a security thing with Apple.
Jailbreaking hacks into the firmware and makes the firmware bypass the signature checking, so applications without the signature can run on the iPod.
--------------------------------------…
To Jailbreak 1st Generation iPods, read the instructions for 2nd Generation iPods.
--------------------------------------…
To Jailbreak 2nd Generation iPods, you can safely update to firmware 3.1.3 first.
The iPhone Dev Team has released a special version of redsn0w, and you can download it here.
http://blog.iphone-dev.org/page/2
You will also need the 3.1.2 firmware for the second generation, it can be torrented.
NOTE: You will need the 3.1.2 firmware to jailbreak the 3.1.3 firmware. There is a difference.
Once the .ipsw (firmware) file is downloaded, fire up redsn0w. Browse and select the .ipsw file, and redsn0w will now ask you a very important question, to which you answer NO because you do not have an MC version of the iPod Touch, that's for 3rd Generation. A failure to answer this question may result in a system restore to fix this problem.
Follow the on-screen instructions from redsn0w, and do not open iTunes. Keep your iPod Touch connected via the wire the entire process of jailbreaking.
NOTE: PATIENCE IS KEY. 2nd Generation iPod Touches may take up to 30 minutes to jailbreak.
--------------------------------------
To Jailbreak iPod Touch 3rd Generation, follow the exact same procedures as 2nd Generation, except answer YES to the MC question. A failure to answer this question may result in a system restore to fix this problem.

Hope this helps =D

well the reason why it doesn't work because the 3.1.3 Firmware blocks the blackrain from jailbreaking it but the only way is to downgrade it back to 3.1.2 so here is the link to get the firmware:

and if you didn't know by now that if you still want to keep you jailbroken ipod touch "JailBroken" then dont update it it makes it go away so dont! hope this Helps :]
