Better than you think. This is a violation of the 10th amendment. There will be concerned citizens joining this class action in droves.

    Source(s): I just joined.

I agree, unfortunately. But once congress voted the law in, we were done for..... The idea, is we voted these people in, to do what we want them to do (obviously they don't) if Obamacare passed then we must've wanted it. It's twisted logic to be sure. Considering 65% of the country doesn't want this law. But now that it IS law, it's even harder to repeal. That's why we need to be careful what laws get passed because once they're passed it's hell to do a repeal process. Unfortunately it's here and it's gonna stay, because this feeds the plans of the dominant parties (whether they admit it or not, both parties win out of this) If there is only one thing I say that people will remember it's this: EVERY single politician is a lying sack of crap, and will do ANYTHING to secure your vote, so that he can get in office and work on their own agenda which has NOTHING to do with the American people. Left right middle, they are ALL pieces of crap who will only use and abuse us. PS: For those that support this law, you are idiots to think that Europe has a better healthcare system than we do, it is bankrupting their economy and even the people use "private" services because the "public option" sucks and they have to wait in lines for basic services. Not to mention ITS NOT FREE!! They pay for the healthcare out of their paychecks, so if you wanted more take home pay..... NOT gonna happen! Any poor person, uninsured, can walk into an emergency room and get seen by a doctor and taken care of in a reasonable manner, now that this Obamacare has taken effect it's not going to be the same. We have signed up our kids, our grandkids and our great grandkids to generations of debt and poor economy. You can't use children as leverage for a debt, which we have been doing since FDR years. It's getting to the point that the system can no longer sustain itself, once we get to critical mass our entire governmental and economic systems WILL collapse. PPS: I love how when people can't take the truth, you get a thumbs down LOL

I think it is a little premature. You can't sue for damages unless and until you have been damaged. Unless you are a liberal politician. Like when Clinton sued the tobacco companies for damages. He claimed that smoking caused cancer and the government spent millions in medical care. Since the government was suffering financial damage due to the money it spent on medical care for smokers then they (the government) should be awarded damages. The courts conveniently overlooked the fact that the government had no money of its own and therefore lost nothing so had no legal standing to sue. The liberal courts ruled that even though the government had not been damaged they could still sue. Because it was such a good liberal idea.

It is the same in this case. Since Obamacare was just passed and won't take effect for another 4 years then there is no possibility that anyone has been damaged. I am sure the liberal courts will take note of this and rule in favor of their liberal president. The fact that the law is on their side is just a happy coincidence.

Zero - it isn't really a lawsuit just another political stunt by the sore losers.

He has presented no case - just a statement that he intends to sue.

He presents no argument - just rants over and over again that he disagrees with the Supreme Court.

He presents no qualifications - just a mention in passing that he went to law school.

He contradicts himself in the little that he does say. He claims the overwhelming majority of supreme court decisions on the 10th amendment since Roosevelt are wrong (but doesn't say why) but then argues Obama should be sued for intentionally breaking his oath of office to support the constitution by acting in a way 100% consistent with the majority of legal precedent on the issue.

He is running for congress in 2010 - so this is just a publicity stunt to get him there.

I support Obamacare. It is about time we made healthcare accessible to all. Now, when I was in the military I had national healthcare. Congress and any federal employee already has national healthcare. Old people have national healthcare with medicare. Most states provide free healthcare through medicaid. In the past you had to become completely broke to qualify for medicare. Obamacare just means the doctors, health industry, and insurance don't make you broke just because you got sick. Think about what happens to your home if you get sick, rack up big bills and no longer have obamacare. Those that hate Obamacare the most are those that have not felt the pain of the old system.

I really doubt the great legal scholar Van Irion will get anywhere with this. the same line of thinking could be used to oppose any legislative act, but congress is well within its authority to enact healthcare reform.

I supported the PO miles before this. This is the largest transfer of private wealth in history and no where in the Constitution does it say that is allowed. This HC bill is crony capitalism at its finest. The insurance and pharmaceutical industries made out like bandits.

This mandate can be deemed unConstitutional, but the court hasn't gone against the populace and political elite since FDR and they lost.

It's even lower than 0%. It's like -57%. And just wondering, who would the petitioners be? The insurance companies LOVE this legislation.

  • 1 decade ago

0%. I looked at the site, you guys don't even have a legal argument yet. You just know you want to sue.

Think about that for a second.
