This guy had murdered four civilian US contractors and hanged them from a bridge to rot. The SEALs captured the guy. He was in a cell. He alleges that he was hit. And he didn't even make those allegations until after he was turned over to Iraqi authorities. The Navy's not accusing the SEALs, they're only trying the case.

It was initially to be nothing more than a "Mast." That's "non-judicial punishment" which equates to an admission of guilt, a reprimand, and a spot on ones record. However, the SEALs knew that it would put all SEALs under the gun. An admission of guilt, albeit a tacit admission, would tarnish the SEAL image. So, rather than "put it behind them" and "take the easy way out," they chose to defend themselves in a Court Martial. This ups the risk. If they're found guilty, they could be in some serious trouble. But, if they're found innocent, their records will be cleared of the incident. Being SEAL, they're looking out for their buddies.

The reason they're trying the case in Iraq is because the prosecution says it's too hard for them to bring their client to the states.

Problem is, they got some mediocre Navy officer (I believe a CDR) who, rather than tell the prosecution, "Bring your client to the States in 48 hours, or I'm ruling in favor of the SEALs," he wimped out and said he'd make the SEALS and their witnesses travel to Iraq.

My take is that the guy busted his own lip and blamed it on the SEALs. Why? You're watching the reason unfold. He gets to look good in front of his guys. He gets to run some SEALs through the ringer. And he might even be able to win a case against them through the efforts of a bunch of shysters.

Seals today are trained to be prepared for just about any eventuality. They go into a situation with the idea of ratcheting up the force only as high as is necessary to maintain control of the situation. And that's how they operate.

A captive in a cell is a totally controlled situation. There's no resistance... no need for force. I know SEALs. I cannot believe they did it. It's well documented that the "bad guys" know that the SEALs don't come in with guns blazing... that they'll offer just enough resistance to get roughed up a little to make it look to their buddies that they put a valiant fight against insurmountable odds. I therefore believe that this guy, if he had been banged around a little, it would have been done during his capture and only because he resisted.

Secondly, while I doubt that any SEAL would break his training like that, I find it impossible that three of them did so. I really don't give a <bleep> about the outcome. I'll believe the SEALs.
