You can sue anyone for any reasons. The only problem is whether or not you could win. When people buy things on eBay, eBay and PayPal are the judges. They decide who is right and who is wrong. If you do not agree with their decision, you can bring them to court, of course. The question is does it worth to sue them for something only worth less than a $100? Does it worth your time and effort to sue for such a small amount? How high the chance are you going to win the case?
When people buy things in the store, they can buy what they see; when buy online, they have to rely on what they see on the picture and the information the seller provide, so, if you want to sell the thing as is, you have to make sure the buyer knows everything about the product. Are you sure your picture and product description are easy to understand as well as 100% accurate? If you are not sure, then, may be you should just give the buyer a refund and re-list the item.

No - you can't sure paypal or the customer.
Just because you say an item is "as is" if you didn't disclose the "as is" condition, it no longer is "as is".
