no they cant touch it while it is in your hands.. get the check cashed and dont put it in the bank. the same thing kinda happened to us. they kept our state refund (state, not fed) becuase my husband owed money for tuition to a university and we had our funds direct deposited. They said that there was a new law passed in our state to where the college/univeristy could keep anything from state since they were a state organization. They said it would keep doing this each year until it was paid for..

No since you do not owe the government. Your problem will be when you deposit that check into your bank account then the credit card company gets it

No, the IRS is not a collection agency for private debts.

However once your refund hits your bank account it's free game for anyone with a judgment against you.
