I don't remember the exact states but it was only 4 or 5, not 17. They didn't get out of the law they simply passed there own regulation that was as tough or tougher than the epa rules.
And yep.... this whole thing stinks.

No, no states got out of this. States have been urged to take over the regulation of the Lead RRP rule and, as of today, 7 states have done so. So lead related work in residential structures is regulated on a state level in those states. All other states must follow the federal standard.
Right now the states with their own standards are Wisconsin, Iowa, North Carolina, Mississippi, Kansas, Rhode Island and Utah. Their rules have to be the same as, or more stringent than the federal standard.
So nobody gets out of it.
