Graduated Income tax is it legal or illegal to file?

I mean graduated income tax is something thats not in the constitution, so we really don't have to file for this.Provide any real websites or evidence for this, I would really appreciated.

    The Constitution says that income tax is legal. It does not specify graduated or non-graduated and says that Congress may decide on the details. Congress decided on graduated, and the Constitution says Congress can decide, as long as it is some type of income tax. It also does not specify which day of the week you may file, so you may file any day of the week.

    There are many things that the constitution does not say. It doesn't have to spell out everything.

    The constitution allows Congress to "lay and collect" taxes. This gives Congress very broad latitude in deciding what to tax. They could tax the number of hairs on your arm, the number of breaths that you take or the number of steps that you take. However, they decided that the fairest form of taxation would be a graduated income tax. Title 26 was passed. It has been rewritten a couple of times but it is perfectly legal.

    If you don't like paying income taxes, renounce your citizenship and move to a country that does not have one like Haiti or Afghanistan.

  • Read Article 1, Section 8 of The Constitution. It states, in part: "The Congress shall have Power To lay and collect Taxes, ..."

    That's ALL the authorization that Congress needs to enact ANY tax. They could legally tax the size of your wiener if they wanted to and it would be absolutely Constitutional.

    There's no ban on committing murder in The Constitution; good luck using that argument in your defense if you are charged with murder. There are no speed limits in The Constitution either but that won't stop you from being cited for speeding in a national park or get you off the hook for doing so.

    The constitution clearly grants congress the authority to levy income taxes and makes no restrictions about graduated tax rates vs flat tax rates.

    Ultimately, what is legal and illegal in our country is decided by the US supreme court. The supreme court has upheld tax laws every time they've ever been challenged. In fact, they've set such clear legal precedence that they won't even hear tax challenges anymore unless there's some unique twist.

    The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.

    Looks like an income tax is legal.

    Of course, if you want to play games with the IRS, have fun.
