Signed a lease but the apartment is no longer available?

My friend and I signed a lease to live in a certain student living apartment about 2 months ago. We were told that we would have an apartment there and we paid our first months rent and all of the fees. But today we got a call that said they don't have any units left in the complex we chose but we can choose to live in one of their sister apartments. We do not want to live in one of the other complexes, we chose this complex for certain reasons (it's close to campus and I don't have a car). When I talked to the people at this complex they said that they weren't sure if we could get out of the lease but they would call corporate and find out. Can they make us pay even though we don't want to live in another complex? We signed up for this one in particular, I feel like it's their fault and we should be able to get out of the lease. I'm very concerned because I have never done anything like this before (I'm only 20) and school starts in a few weeks. Please help!

    Read the lease. It might say that if that apartment isn't available they can substitute another. I hope though, that you read the lease before you signed it and would have balked at such a clause. If the address or unit or whatever is defined on the lease, then they need to refund your deposit because they cannot fulfill the terms of the lease. You may need to go to small claims court to get your money back. Does your school have a law department? If so they may offer legal assistance for students.

    First you will have to file a complaint indicating that you feel management acted on bad faith.

    Secondly that you feel managemnet new that the unit was not going to be available.

    Lastly that your verbal agreement even though you signed the Least that management showed you, walked you through, and signed the agreement.

    Dont forget, that you are not the only one that has had this problem... Believe me you wont have a problem.. You will win. Apt Management are having problems filling in these units, so they will do what ever is necessary to rent these units.

    What does your lease say about management not being able to provide you with an apartment in that complex?
