Gay marriage ban overturned?

I'm not knocking gays here but............So, the people vote for or against something, and a judge can overturn that. So there is no more Democracy, just what the courts and government want and not the wants of the majority vote of the people?

Sounds familiar! In just about the cause of every war, especially the one that ended in 1776!

You are just mad because the queers won and you lost. Gays and Lesbians have a right to marry. You seem to forget that we do not live in a Democracy. It's not mob rule over here. If it was then slavery would have been put to a vote and every black person would still be in chains. Maybe you would like that.

All those in favor of reinstituting slavery say aye! White folks make up sixty per cent of the population. That is why colored people are called minorities.

What we have hear is not what the majority of people want, it is what is just for a group that is in the minority. Just like the Jews, the Blacks, and the Gays.

Hilter was an elected official before he became a dictator. He was elected in a Democracy in Germany and look at what happened. Sometimes what the majority wants isn't for the common good of the country.

This is why we have judges and courts. We have a balance of power. Otherwise, mobs of people like you would be lynching OJ Simpson in the town square like Wyatt Earp did to the cowboys.

Actually, the people elected representatives (the California Legislature) to represent them. That's the representative democracy that we live in. We vote for people who supposedly write laws that we want them to. So basically, the people of California voted for Legislators, and the Legislators decided to legalize same-sex marriage.

Then the people of California decided they did not like what the Legislators had legislated. And so they decided to overturn the law with Proposition 8.

So the Court is just putting the law back to the way it was. Marriage was officially and legislatively LEGAL in California before those rights were taken away.

Our system is not a popular democracy, we are a representative democracy. That is what was decided after our Revolutionary War by the founders of our great country.

no you are wrong , democracy allows all to have their say and the majority elects leaders.

but that does not mean that minority rights can just be trampled , it means that the court is doing its job.

imagine if all minority rights were just swept under the carpet, we would be in a mess.

the judge is rightly giving gays equal rights with married heterosexual couples and denying discrimination on any grounds, again right.

but this also does not mean that gay marriages will just flourish, it is still open to the supreme court to decide and even if a referendum was held the majority usually opposes gay marriage.

ironically california is supposed to be one of the more liberal states but other more conservative states have already allowed gay marriage to take place.

Quite right, except that that War started in 1776, rather than ending.

But, as they said in the Declaration of Independence: "Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn that mankind are more disposed to suffer, while evils are sufferable than to right themselves by abolishing the forms to which they are accustomed."

So the next step will be to pass a US Constitutional Amendment, in an effort to ensure the will of the people. We haven't yet reached the point of needing to overthrow the government.

It's called the Constitution. Neither the public nor the government can make illegal laws. Prop 8 was illegal under the Constitution, as we told you from the beginning. Whining bigots didn't want to hear it. People don't have the "right" to vote Mexican immigrants their slaves either (I bet you could get a majority). If you don't understand this or think this isn't democracy you need to go back to grade school. It's basic civics.

    Now CRY MOAR.

The Constitution for the United States dose give the federal government or it's agencies authority to dictate social norms . That power is in the hands of the states and the people .

If the states and the people do not stand up for their rights then they permit to being slaves to the federal government .

Gays are persistent. So the straights better stop thinking they will run gays out of town on a rail. A homophobic straights only problem is that they don't realize that some of their children are gay, and their family. ...maybe even themselves. Closeted homosexual straights always fight the hardest to squash gay peoples freedoms because they can not face what they are. Hurray for victory! Gay people will NEVER allow their rights to be taken.. NEVER!

A judge is suppose to up hold the law as it is written not change it to fit his opinion or political agenda, which is what the majority of liberal judges do now. This is the only way they can get their goals accomplished. Liberals will continue to use slavery and racism as a way for justifying the gay agenda, but their is no comparison because being black is not a choice, being gay is, they will tell you it's not a choice, but so many now are bi-sexual, trans-gender, transvestite or some other confused mess that makes it obviously a choice, and make no mistake they are fighting for their rights too, so next time you have to hire some trans-gender/transvestite freak just remember why, because it's their right to force you to accept them.
