caught speeding without a driving license - what happens next?
Had a letter through caught on camera speeding. I own the vehicle. The speeding offence was not committed by me but by my boyfriend who took car without asking. He has no insurance and no licence, not even provisional. SPeeding was 38 in a 30. What happens if I say it was him driving? What happens if I say I was driving?

If you say it was him driving, the police will ask you if you gave him permission to use the car. If you say yes, they can charge you with aiding and abetting driving without an insurance or licence, which pretty much means that you will also get points and a fine. It is usually 6 points for no insurance and 3 for speeding, so if either of you already have points, it will take you over 10 points and you will be disqualified from driving under the totting up procedure. Usually for 12 months. If either of you get points on your licence, it is likely that your insurance premium will increase, and if you do get the nine points, it will increase by a lot, and some insurers may refuse to insure you.
If you say it was him driving, but that you did not give him permission to use the car, only he will get the fine and points, but he will also be charged with taking and driving away a motor vehicle which will incur further points, an additional hefty fine, and a possible custodial sentence for theft. He will also be extremely likely to be banned from driving, both for taking the car without your consent, and for exceeding the 10 points.
If you say it was you driving, only you will get the points, but if they find out that it wasn't you driving, (for example if you passed a camera which photographs the driver), you risk a custodial sentence for fraud. He will also be charged with fraud for asking you to take his points, and the original points will be given to him.
I always find that it is best to be honest in these cases as the police have seen it all before and know every trick in the book. They do catch a lot of people for doing things like this, and the consequences of having a criminal record for fraud are not nice. It will affect your job prospects, your credit rating, your future insurance premiums, and it will also be in the papers which is humiliating.

You can bet the police also has a photo of who was driving the vehicle when the camera took the photo. If you say you were the driver and they show the actual photo of who was driving you may and most likely will get yourself in trouble. Your best action would be to tell the truth because the photos show the truth. I am guessing since you mentioned something about saying it was you driving your boyfriend has some problems with driving and the law. Otherwise, just a speeding ticket for what you say isn't that big of deal. If he has no problems then he may loose a couple points on his license and have to pay a fine and his insurance will increase if he has insurance. Better just let him deal with the situation and you stay out of it. The more you get involved the bigger chance it is you will get yourself into trouble with the judge. Tell him to pay the fine and whatever else he may have coming and let it go at that.

If you admit it you get 3 point and a fine. But, if its a front facing camera and they have your boyfriends picture you will first get a letter stating that the gender of the driver is in conflict with the evidence. You will not be immediately investigated for "attempting to pervert the course of justice" .Obviously some people can have several people driving their vehicle during a week.If your boyfriend admits the offence he will be dealt with for the speeding offence, no driving licence and most seriously no Insurance. He cannot have Insurance if he is not the holder of a motor driving licence.You will likely have to provide a statement that he took the car without your authority and then he will be charged with that additional offence which is a criminal matter He is in the proverbial Sh*t and will probably get a very large fine and driving ban. Its up to you which way you go with this.

Say it was him - if the car was not reported stolen at the time then you both get done for all the offences he commited as they will assume you gave permission and so aided and abetted him.
If you say you were driving then you get at least 3 points and a £60 fine - cannot say more than that because you have not told us your licence and insurance status other than if you take the points and they find out you will be prsecuted for perverting the course of justice - nearly always means jail!
So tell the truth and accept the consequences

Firstly, you are a total prat for letting him drive.
If you fill in the form as if you were driving then you will get the points and a fine and there is also the possibility that they will find out that it was not you driving and do you for perverting the course of justie. This carries a custodial sentence.
If you say your bf was driving then it will be obvious that he has no license pretty quickly as the license has to be sent away for endorsement.
The safety camera partnership will then send the details to the police who will take action against him for driving without a license and hence no insurance.
They will then also likely come after you for allowing him to drive without these items.
If as you say he took the car without your permission then he will also be done for TWOC (taking without consent) and hopefully get a custodial sentence.
either way, you/he are potentially are in deep doo doo.

on the letter it will say where he got caught ..if its a normal speed camera then it will photo the back of car not front ...so they wont know who driver is ...so you have a choice ...tell a lie ..take the rap ..and keep quiet ...but is he worth it ?he will get done for speeding..no licence ..no insurance ..and probably taking car without permission ...you will need to give evidence ...if you say he had your permission ..then you will get done for aiding and abetting ....hope he is worth it!

Since he puts your computer at risk looking at porn (and I hope you have since done a good virus scan) and it now putting your car at risk by driving without a license, why would you even consider doing anything to take him off the hook for his stupid behavior? Just tell them your (hopefully ex) boyfriend took your car without permission and was driving without a license, and let the fault fall on him.

Him: Summons to court driving without licence and insurance, and taking without consent (if you say so).
You: 3 points and a fine, don't bother saying it was you, he needs to learn that being stupid has consequences.

Brainless w*****s who drive without insurance cause misery and expense to those of us who choose to drive legally.
