Question about filing for bankruptcy in California...?

If I'm thinking about filing for bankruptcy in California, how much will it cost me? And just as important, what kinds of documents and info should I have prepared before I meet with a bankruptcy lawyer?

    Gather all your bills and your last 6 months of pay stubs (or know how much you made in the last 6 months) and ask for a free consultation from a bankruptcy attorney. You have to show them how much you owe and how much you make. There is a means test that you have to satisfy to determine which chapter of bankruptcy you qualify for.

    Bankruptcy law differs from state to state. In North Carolina, it cost me about $5,000 to file a joint chapter 13 bankruptcy with my wife. Could have been a little more because they worked some of the lawyer fees into the repayment plan. There is more flexibility in paying the lawyer in a chapter 13 because you pay back a portion of your unsecured debt & some of the lawyer fees can be leveraged into that.

    With a chapter 7, there is no repayment plan and you have to pay the attorney 100% up front, but they can show you some things you may be able to do to come up with the money.

    The first consultation is free. I would at least talk to an attorney.

    You can file the bankruptcy on your own but it is highly recommended to engage a legal representative. Based on your financial profile and debt amount he can assist in filing amongst the apt bankruptcy chapters. The representative will help you in completing the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA).

    As far as concern the cost for filing the bankruptcy, usually the charges can be in and around $1,500 depending upon the complexity involved and lawyer’s fees, the state etc.

    You can get a free consult with a bankruptcy lawyer. Ask them what you are supposed to bring when you come in to talk .

    I have seen here bankruptcies costing as much as 5k. It all depends on your case, your lawyer etc.
