can my husband add his name to my son birth certificate?

Me and my husband recently got married. We want to add his name to the birth certificate because my son's biological father has not signed it and will never sign it. i received a letter saying i can terminate child support.so once i did that my husband wanted to take over responsibility. Is this legal?

Update:

i know you have to go to court but is it ways around it? my son is 4 i have never put my sons birth father information on anything.so if my husband just sing the paper saying he is the biological father than it should be legal without going to court right?

No. Your husband cannot put his name on your son's birth certificate. That is considered fraud by forgery. But he can adopt your son if the child's father is willing to agree.

I'm interested in the letter; did it come from the boy's father, with intent of getting out of paying child support?

By the way, a father doesn't need to sign the birth certificate. All you have to do is identify him as the father. Then HE has to demonstrate that he isn't baby's the father if he wants to dispute it.

    i doubt it.

a birth certificate is a legal paper.

why would you want to forge a legal document.

    there are other ways .

you should go after the father for child support, not give your new husband 100% of the burden and the child support if a divorce ever happens.

No you have to go to court and have your husband legally adopt him. It's not something you can do by yourself.

NO. not without an attorney. he can adopt your son, but it's a procedure to follow.
