I need help on a legal term.?

So I am required to drug test for my employer. I have no problem with this. But not everyone has to do it. It's like they test the people they know don't do drugs, when there is suspicion of others doing so. Is this discrimination? or just favoritism? Thanks to all who answer.

Update:

I know what a drug test is. I want to know what it's called when they test the employees they know are clean, and not the ones they know are using drugs.

It's called a random drug test and they're perfectly legal in most cases. Where I worked before HR had a computer program that once a month would randomly select 10 names and those people would all have to be tested that day. Because it was truly random some people could get selected 3-4 times a year and they would usually get very annoyed, but there you have it.

If there was somebody that the company suspected of drug use that person's name somehow always found itself on the randomly generated list...

So you have the employment records for all of your co-workers, and this is how you have first-hand knowledge of all drug testing at work? Hmmm, very unusual. I suppose it could lead to discrimination in hiring, compensation, or promotion, and if there are more than 15 employees fall under the EEOC regs. See http://www.eeoc.gov/
