data plan w/this phone and it also has wi-fi capabilities, so my dumb question is do i have to be in a wifi hotspot to access internet? and is this a good phone overall?

No, if you buy a data plan you can use your carrier's 3G network to use the internet. Most carriers have very large 3G networks so you should be able to get internet everywhere. However, if you are in a wi-fi hotspot you can choose to use wi-fi instead. The Samsung Acclaim is a nice smartphone with a great touchscreen and 3.5 mm headjack. Also it has Android 2.1. However, I dislike that the space bar is in between letters and it throws me off and the keyboard layout is just kind of awkward. The price is reasonable and affordable. The 3.0 megapixel camera with LED flash works nicely. Overall, it's a decent smartphone for the price. Hope this helps. (:
