Am I entitled to a new mobile phone ?

I have a nokia e72 on a virgin media 18 month contract. I've had the phone and contract for about 7 months now.

For about 5 months, the phone constantly crashes, freezes and generally bugs out most days.

Am I entitled to send it back to virgin and ask for a new handset??

    Yes you are. You should have done it sooner. They have the option of repairing it, if it can be repaired, supplying a new one or giving your money back. By the way the contract is for the network not the phone. Your phone has a minimum guarantee of 1 year.

    Hi Chris right what will happen with your phone is that it will be sent back for repair! if your phone then develops the same fault 3 times then you will be entitled to a new handset but what it sounds like is the phone has a software issue which can be easily sorted out for you but in all honesty if the phones been playing up for the last 5 months then you should have sent the phone back as soon as the problems started... sly

    No, at five months they will offer to have it repaired for you. Make sure they loan you another one for the repair period.
