should i seek an attorney?

my mother had no will made up. she did have her home and land in mine and my brothers name before she passed away. she had made it to where as long as she lived she had the say so on that property. now that she has passed away my brother has changed the locks on the house. moved in and now is controlling all that she has without my permission. i am part owner of another piece of property and know that i am allowed to come and go out of that house and land. does that also apply toward my problem with my brother? he does have his name on mom's bank account and is over her life insurance policy, which is not that much. very little as a matter of fact. so i know i don't have a say in that. but what of the house and land?

    Oh Hip im so sorry bout your mother and for the other i would seek counsel. Just make an appointment and ask his or her's advice.

    so sorry to hear about your loss

    here's my advice.

    search around town and talk to friends, find the best attorney for your particular situation.

    talk to him, and keep him on hand just in case.

    but before you take legal action,

    get ahold of your brother and tell him it's time you two had a talk.

    you may find that that this matter can be solved in a civilized conversation with your brother.

    legal action isn't always necessary, as it is expensive and can be a drawn out process.

    explain to your brother that your grieving and that this is the last thing either of you should be worrying about right now.

    bad blood between family is never good.

    dealing with your brother face to face may be your best option hip.

    fix whatever problems you two have, so you don't have to bring these issues back up later.

  • The state probate court will divide the estate equally between the two of you. It never hurts to hire an attorney in these cases though. Different states have different estate laws including how long the property must remain in probate before it can be divided. Your brother does not have any more legal rights to any of this than you do. Take care my friend.

    looks like it with your mother not leaving a will theres no one who gains.The entire estate will be spilt between you both if your able to purchase it that's up to you ,you'll pay half the market value with bank accounts these will be frozen so your brother will be unable to take any money from them only expenses,in times such as yours you have to stand up for your self pity your brother cant see the expense you'll both have to pay for this service when you could sort it out your self's saving both from another bill to pay

  • Yes, you should definitely have an attorney. It does not sound as if your brother has your mutual interests at heart.
