Is there ANY way at all I can use my warranty on my ipod touch with these conditions?

I bought this ipod touch used and i really would like to use my warranty and get a new one. this ipod has scratches on the screen and all over the back. it sometimes freezes up when im on the internet but it rarely happens. Is there any way at all i can use my warranty!?!?!?!?

    if your warranty is through apple or if you have apple care, you could explain your problem to the people at the genius bar. they'll do some diagnostics on it to see if there is anything wrong with it if it's freezing, but for scratches, no - you can't use your warranty, that's accidental damage. apple does not, will not, never cover(s) accidental damage.

    I searched a similar question yesterday. during the process of trying to search the solution I stumbled upon a way to get a new ipod touch for free from www.cyber16gbipodtouchworld.tk!! mine is arriving next week and i'm so happy!!

    Not unless it came that way. Warranties only cover defected devices or ones that were accidentally damaged...scratches aren't accidental.
