Bought a used Blackberry Bold 9000. Software?

I bought this off Ebay and it's worked fine except I guess the person who had it before me used it for business and the password is locked on there and I have to enter it every 2 minutes. ANYWAY, I want to start uploading pictures and music. Am I allowed to legally download the free software from the website, even though I'm not the original owner of the phone?

And how can I wipe it but save my contacts?

    Yes. I would the BlackBerry Desktop software to thoroughly wipe the phone and upgrade the OS.
