EPA to loose ability to regulate CO2?

Jay Rockefeller, ultra liberal senior US senator from West Virginia, is proposing a senate bill to remove or severely limit the ability of the EPA to regulate CO2. It appears he will have more than the 60 votes needed to advance the bill, is this the beginning of the end of the EPA's ability to enforce a "Cap and Trade" program upon the US without the consent of the Congress?

JRock understands the need to adhere to the US Constitution, that separation of power means that certain decisions must be made by the legislative branch, not by the judicial and executive branches. The current rules allow the EPA to regulate CO2, the US Congress can change that rule at their pleasure, that is their constitutional responsibility. It appears Senator Rockefeller, who has never before seen a government program he did not like, is not happy with the current administration, or their EPA administrator's decision to take over permitting for new CO2 sources in Texas.

    Good idea.

Murkowski's dirty Air Act did not bypass interior the Senate, June 2010. Will Rockefeller's revival of the dirty Air Act fare any in yet otherwise, so without delay? Rockefeller, who's received $350,000 in marketing campaign contributions from the coal and oil industries through actual reality 1999, tried to squeeze his bill in as an change to the omnibus appropriations bill in the previous the Senate adjourned this 365 days. that did not artwork. So it may no longer be except January fifth, 2011, minimum, that he receives an additional possibility for a vote. The EPA and state environmental businesses issuing greenhouse gas enables on January second, 2011. those facilitates could no longer a carbon tax, or a cap-and-commerce scheme. They in reality require that new construction or boom of the most important business greenhouse gas elements, equivalent to electric powered technology, business boilers, paper turbines, cement factories, landfills, and metallic and oil refining, want to include greenhouse gas emission manage technologies. cutting-edge elements, and smaller elements like small farms and eating places, could nicely be exempt from the allowing requirement.

Murkowski's Dirty Air Act failed to pass in the Senate, June 2010. Will Rockefeller's revival of the Dirty Air Act fare any differently, so soon?

Rockefeller, who's received $350,000 in campaign contributions from the coal and oil industries since 1999, tried to squeeze his bill in as an amendment to the omnibus appropriations bill before the Senate adjourned this year. That didn't work. So it won't be until January 5th, 2011, minimum, that he'll get another chance for a vote.

The EPA and state environmental agencies begin issuing greenhouse gas permits on January 2nd, 2011. These permits are not a carbon tax, or a cap-and-trade scheme. They merely require that new construction or expansion of the largest industrial greenhouse gas sources, such as electric generation, industrial boilers, paper mills, cement factories, landfills, and steel and oil refining, must include greenhouse gas emission control technology. Existing sources, and smaller sources like small farms and restaurants, will be exempt from the permitting requirement.

We can only hope so. If not economic disaster is just around the corner. By the way the EPA has no authority to start a CAP & TAX system. It has not been passed by the legislature. And it has no chance in the new Congress.

We wouldn't need the EPA if industries were responsible and put the general public's welfare above the almighty dollar.
