Ok so I sold my ex's Wii?
He "gave" me the system over four months ago, we broke up in the end of august, he said he would not take it back and he would send it back to me if I tried to send it to him through the mail. I waited for months for him to say he wanted it back, I got tired of having it and tired of looking at it and tired of the emotions that were attached to it so I sold it after four months of waiting, for him to take the damn thing back. Does he have any legal right to get it back after I have had it for four months?

If he refused to take it back then it's not your responsibility to keep it. Good on you for selling it.

If that is the exact way it happened, it is a gift.
It is not a gift in contemplation of any event, like an engagement ring given in contemplation of marriage. In cases of engagements, in many states the ring must be returned, even if it was totally the giver's fault the engagement broke up. Because an engagement ring is a gift in contemplation of marriage, and if the event doesn't happen, the gift goes back.) So nope, it was yours and you had the right to sell it.
Hopefully he won't give you any trouble on something that really isn't worth the effort for him, or you.
Good luck!

since he gave it to you, he already pass the ownership to you. you are free to do anything with it. you did say want to return him. but he rejected it. he has no right to take legal action against you. moreover, its just a 200 dollars console. the amount he pay to a lawyer would cost more than the wii.

confident the Wii and the gamecube are backwards like minded completely. there is not something incorrect with putting a gamecube activity interior. It sucks it up the comparable way it sucks up a Wii activity so there must be no issues of it in any respect!!!

Sure sounds like he gave it to you and would have refused to accept it back if you tried to return it. So yeah, it was your machine to do with as you will. The money is all yours too. Don't return *that* either if he complains down the road.

No, he does not have that right. Also, assuming he's over twelve any judge would laugh him out of court if he tried to sue. ianal

If it was a gift he has to legal right to take it back. (If I give you $100, and try to take it back do you have to give it back?)
