bankruptcy rules or laws in NY?

My daughter in-law wants to file bankruptcy. She has no work income, 3 children, lives off social services, food stamps and very little help from her ex. Recently re married. His only income is a check every 3 months from the Seneca tribe. He works when he can but has physical issues and usually loses a job due to not being able to work when needed.

The only debt that I know they have is medical bills from the childbirth, store and credit cards, and his past child support.

We help out as much as we can financially but it has put us behind, so we drew the line.

She lives in NY. Anyone know if she would qualify for bankruptcy?

They don't have a computer or internet so they asked me to find info.

    Just contact a bankruptcy attorney and see what options are available. Usually the first visit is free

    They should consult a bankruptcy lawyer. Bankruptcy is governed by the US Bankruptcy courts, i am including the link to their basic info page.

    As the previous poster stated, child suport does not qualify for discharge nor does money owed the federal government (gotta love the government, they will forgive money owed to everyone BUT them :).

    I would also check into programs available for members of Indian tribes (I am basing this on your mention of the Seneca tribe). There are many programs for American Indians that are not available to others. I am also including a link to the American Indian Community House in NY, they do job training, education assistance... And may be able to point them in the right direction. Tjere is also the Bearu of Indian Affairs which also has financial assistance programs.

    I usually avoid commercial sites for info, but it sounds like you are flying blind so I am also attaching a blog written by a bankruptcy lawyer in NY and he has a lot of good basic info.

    Anyone can qualify...but the child support will not be discharged. Tell her to get a job.
