Turtle Beach Earforce PX21 Headset broken?

Its been a while now, turtle beach refuses to repair or replace, since the warranty only covers "defects", not accidents and such. So my left earcup is dangling but a wire from the headband to the earcup. I have to tape it up, and it doesnt give a natural fit around my ear anymore since it uses tape for support.

Its really starting to piss me off to because of the douchebag move by turtle beach.

Would anyone know what I should do? I wasted $80 for 3 months of a headset.

Update:

Apparently its not covered. they said this, I sadly worded my complaint that it had accident hidden in there, so they refuse to repair or replace accidents, only defects.

    This is covered by the Turtle Beach warranty. You should send an email to Support@turtlebeach.com and tell them what happened. Their customer support is great.

    I agree with Julian. I had a question for them a while ago and emailed them at support@turtlebeach.com and they were very helpful and friendly.

    Same happened to mine ffs -.- . they dont fit on properly and it is the left one as well. I have to tape it but they're so tight it just slips off no matter how much i use.
