If a community takes law into their own hands and kills someone how bad could the punishment be?
A gang of thieves have been terrorizing a community so the community (not sure how many people) took the law into their own hands and beat one of the gang members to death. The question is how do they determine legal punishment? Is it the person with the fatal blow who gets the harsher sentence? What happens to those who took part in beating him? What about the witnesses who just stood by watching?

Murder is still murder.
Testimonies will be looked at again and again to determine who did most of it. who instituted most of it and so on. punishment will be dealt out accordingly. most likely not all will be punished as there were so many.But the police will try and get justice from as many as possible.

Vigilante murder, is still murder
the worst punishments would go out to the ones they could prove took a direct hand in the death and those who instigated the beating. In past such gang slayings, they often prosecuted people the harshest, who did not stop when the man was down. That guy who puts the boot to the head, after the guy is on the ground.
More often then not, the worst punished is the last one to cut a deal.

depends on specific facts of this case....
also depends on where...
in lots of states castle doctrine and such would apply .....so killing thief *could* be ruled as self defense or defense of property or others....
** in any case the "mob" has several ways to handle the charges.....there is even a "mob mentality" defense....
