Evidence in Sex Offender case?
For school we have to write an essay about what the conviction would be and i want to know what the public opinion is.
So a six year old girl claims she is raped by a seventeen year old boy. This girl comes from a family with a mother in and out of jail and brothers who hate the accused guy. The girl changes her story multiple times. The accused has an alibi to everything the girl says that can be proven by multiple witnesses. What do you think the final guilty/innocent decision will be?

I think that since the girl is only 6 years old, with her mom in and out of jail all the time and since her brothers hate this boy, then maybe her brothers convinced her to tell the police that she was raped. Evidence of this would be that she keeps changing her story so it may have never happened but there is also the fact that she's six. The police might charge the brothers with obstruction of justice or something or for lying. the 17 year old would be innocent.

Well... the judges and jurors are very sensitive about those cases. By example, months ago, they discovered a case like 10 years ago whereto the guilty man resulted to be innocent, and he was convicted of rape without proves (only the testimony of the "victim").
The correct thing to do in this case is to declare the guy not guilty.

Guilt or innocence will be determined by any physical evidence or lack of, and the credibility of the witnesses, if a jury trial the sympathy will be with the child so a guilty verdict is likely, if it is a bench trial the person stands a good chance of being acquitted.}{

This sounds like an actual rape case where it was proven the men didn't rape her. The Duke Lacross case. She changed her story a bajillion times. She said she hadn't had sex before the alleged rape, but, had loads of semen in her that was present before the "rape", but none of it from the players being tried. You should look into it. It's an excellent of example of females lying about rape just to save face not caring who they hurt on the way.
