Questions about custody issues?? What do I need to do?

Me and my sons father are not married. We have split up. My son is 8 months old. I would like to go for sole custody, and he can get unlimited visitation. But I do not even know where to begin? He so far has not come to see his son. I do not know if he even cares about his son now. He partys all the time and whatnot.

Where do I start? Can I do this without going to court? What documents do I need? Where do I find them?

    You need to go to court for this. It is no big deal.

    I doubt you will get sole custody though, the father has equal rights to yours. You will get shared custody with you as primary care giver.

    Since you were not married and haven't been to court, if your son's father did not sign an affidavit of paternity (commonly called "signing the birth certificate"), you already have sole custody, since paternity hasn't been legally established.

    If he did, you have joint custody rights unless/until a court says otherwise.

    If you want to terminate all his rights to custody, you will need to hire an attorney. That cannot happen unless he's found to be an "unfit" father.
