Questions about custody issues?? What do I need to do?

Me and my sons father are not married. We have split up. My son is 8 months old. I would like to go for sole custody, and he can get unlimited visitation. But I do not even know where to begin? He so far has not come to see his son. I do not know if he even cares about his son now. He partys all the time and whatnot.

Where do I start? Can I do this without going to court? What documents do I need? Where do I find them?

    If he has not come to see his son, you have undisputed custody at this time. If he decides he wants to see your son, then it is HE who would need to get a court order, unless you give him permission.

    If you want something in writing, then look in the phone book ( yellow pages) and call Legal Aid in your community. If you have the means, you may call a private attorney.

    If you're in the UK it's pretty simple. Mother has sole custody automatically unless she is the one who leaves. You do not have to offer him access, if he wants to see his son he has to go see a solicitor and apply through the courts for a visitation order. At that point you can choose to allow it or contest it. If you wanted to contest it you would have to prove that it was in the child's best interest not to see his father but it would be up to the courts to decide.

  • Where are you from? because i`m English and i`m in the same situation, but i automatically have sole custody of my children, in fact i`ve just been to court with my ex just so he can get visitation rights, he now sees them once a fortnight, go see a solicitor and ask about your rights

    As already mentioned, if you're in the UK you automatically have sole custody.

    Just wait it out, see if he comes to visit your son, and tell him the terms to seeing your son, to whatever you feel you're comfortable with.

    If he tries to go through courts, they will do nothing but tell him the same thing.
