Can my daughter change her daughters surname?
She never married the father but hes on the birth certificate and their daughter has his surname. Thank You

Yes, your daughter should be able to change her daughter’s name with a Deed Poll and without the assistance of an attorney, however, I recommend that she go ahead and notify the biological father of the name changes and
There are occasions when someone might want to change his name, either for personal reasons or for professional ones. In the U.K., the process of changing a name is simpler than in many other countries. The legal document used for this purpose is a deed poll, which anyone can create. It also allows the parent of a child to change that child's name if the child is under the age of 16. The process does not require registration with any particular official body or organization, such as a court. The deed poll can remain in the possession of the person creating it, and as long as it was properly constructed it is legally valid.
1. Determine if you have the authority to change the child's name. In the U.K. this authority is based on parental responsibility. Generally a mother automatically has parental responsibility. However, there are circumstance in which the biological father might not. If he does have parental responsibility and refuses to accept the name change for the child, then the mother will have to petition the court for the change and offer evidence why it would be in the best interest of the child. The court will consider the evidence, the father's opinion and the child's if he/she is older than 11.
2. Obtain a copy or template of a name change deed poll to use as a reference when creating your own (see Resources). The top of the deed poll should say “Deed of Change of Name.” Below this, you must enter the date the document was created and make several statements affirming that you are changing the child's current name to the new one you list. You should also make clear that you will contact all official agencies and businesses that you have a relationship with and notify them of the change.
3. Sign and date the document at the bottom. You also need to have two witnesses who must also sign and date the document. All parties involved must provide their full names and addresses, including the county they live in.
4. Take your document to the agencies and businesses you want to change the name with. For example, you will want to change your child's passport and any other official identifying documents. In addition, any businesses that you have a financial relationship with, like a bank, should also be notified.

If the child’s bio father is on the birth certificate, then you will need his permission to change the child’s name. If he has been an absentee father you shouldn’t have any problem but you should go ahead and enroll the deed poll in Central Office of the Supreme Court. A fee is payable to the court.
This will create a public record of the change of name. Only British, British Dependent Territories, British Overseas or Commonwealth citizens and British subjects who are permanently resident in the UK are entitled to enroll a deed poll. The change of name would also be advertised in the London Gazette. A fee would also be payable for this.

I imagine the situation is much like it is here in the US; before 9/11 one could change their name “by use” without encountering any problems but now it must be done legally just to get a driver’s license and in the case of a child you will need proof of the name to enroll them in school. However, the process is relatively simple and you can save a lot of money on attorney fees by filing it yourself.
Also, you may be able to save a few dollars by asking to not advertise the name change since it is a minor, they allow this in the states...ask before you file.

Yes! As The_Emro says you can change it by deed poll.
But for what ever reason you want to change her name,you must remember that every child is entitled to know their birth right? One day she will be entitled to know who her father is.
