Can I get around the Verizon data plan?

I know this question has been asked but I have a different scenario.

I have the LG Chocolate Touch and it is on its way to breaking. Not because of abuse just overuse. One of the buttons doesn't respond as it should every time. Ive brought my old phone back and Verizon gave me a new phone for the problem and they said once that phone isnt made, if the problem persists they will give me a phone of equal value. Now, the Chocolate Touch is not made anymore and Verizon will give me a phone of equal value and ALL of the phones of equal value require the data plan. Will I be able to get around it?

Update:

Thanks! That helped alot. Im probably going to go in soon and see what they say.

you should be able to.... you should be, whats called---Grandfathered, into your current plan... if your currnet plan has a data block, and this is NOT an upgrade (very important), then the data block will follow because your grandfathered into your current plan..

BUT---once you upgrade, you LOOSE ALLL grandfather status... and you cannot escape the data plan

no you won't be able to get around the archives equipment. why purchase a blackberry if your merely going to apply it to communicate? to look cool? your telephone won't paintings correct if its not have been given the internet. you will even have an staggering bill for archives costs at .25 according to mb when you consider that your telephone is on line 24/7. pay the 30. I certainly have considered telephone expenses over seven hundred for this reason. *former vzw csr*
