In absence of any prior lease conditions....landlord or tenant need only give 15 days notice to terminate a month to month tenancy at will. This is Florida statute 83.03.

It really depends on which state you live in. In Wisconsin if they have been living there longer then I think 30 days you can not just kick them out. I think you have to give them 30 days notice. Just like you cant keep their stuff if they are behind on rent. You really cant get a straight answer unless you tell us what state you live in. But the best thing to do is search for a tenants rights website and go from there. My guess is that MOST states if not ALL states always side with the tenant and will not allow you to kick them out with out notice. So do your research before you just kick someone to the curb. But then again look at the person you are kicking to the curb. Do you really think they are, 1 smart enough to know they have rights? 2 have the drive to actually follow through with the process to get you in trouble? If the situation is bad enough I would just kick them out and let the chips land where they land.

You can kick them out anytime. If they refuse to leave, call the police and have them arrested for trespassing on private property.

you can just kick them out if they don't have there name on anything to do with the house or apartment

I believe no notice is required. It would be better if you provide your country.
