Can I press charges on this guy for giving me a concussion?

Today, I was in subway with my friends for lunch and there is this messed up kid in my English who has ADD asburgers. I was throwing lettuce at him to see what he would do and he did nothing but sat there. After I finished my food the kid left at the same time as me and a started spitting on him and he spat back at me so I pushed him and he put his foot behind me and pushed me causing me

to fall back and hit my head giving me a concussion.

Will he get away with it because he's retarded If I press charges?

    You were committing assault and harassing him by throwing lettuce at him! He won't get away because he is "retarded". There are no laws making it legal to commit crimes just because you are "retarded". By the way, people with Aspergers aren't mentally challenged and some even have higher IQ's than the average person! Your harassment angered him and everybody loses control of their anger when they are being harassed. Why not leave him alone? Just because he is different doesn't mean you have the right to harass and bully him!

    If I were you, I wouldn't press charges. You aggravated and assaulted him, and due to his mental state he didn't act as an average person would. You also admitted to the assault, so if you pressed charges, you would most probably lose, and he could sue you.
