Is a BAC of .08 excessive for a DUI?

Ideally, nobody should be drinking at all before they get behind the wheel. In most other civilized countries, the threshold for DUI is considerably lower than .08. Even in Russia, where many people drink beer with an 8-10% alcohol content in the subway or on the bus ON THEIR WAY TO WORK in the morning, it is lower than .08.

Technically you can be arrested for DUI if your BAC is .01 if the officer can show you were impaired to be a hazard. .08 is the current legal limit for being intoxicated. Everyone will handle alcohol differently though.

As a former cop I have seen the aftermath that drunks cause and I hold no sympathy for anyone that gets arrested for DUI.

You can also be arrested for DUI if you were under the influence of illegal narcotics or medicine.

Several years ago I took part in a test with some others run by the Louisiana State police. We used a driving simulator and drank and tested at various BAC levels. There were some that started failing the driving test at .06 and others that made it to .14 or .15. I didn't have a problem until about .13

.08 is MORE than enough to cause an accident. In fact, they should lower it to ANY alcohol content.

I have seen people with less than that not be able to function....u gotta draw a line somewhere.
