Was I Giving Up My Rights By Allowing TSA Scan or Pat Down?

The Transportation Security Administration has come under criticism for the level of detail in the full body scan or enhanced pat down procedures of a 6 year old girl or a 95 year old woman with adult diaper. I believe I was not giving up my constitutional freedoms by not opting for the pat down or not cooperating with the TSA. Others say that our rights are slowly being compromised and soon there will be checkpoints to get from one state to the next. What does the law specify and why don't more people complain?

You have a complete right to refuse the enhanced inspection. You simply turn around and walk out of the airport.

The Supreme Court has ruled that access to aircraft is not a protected right, so security measures do not infringe on that right.

In other words, if you want the privilege of boarding an aircraft, you submit to necessary searches. End of story.

Sorry, screening passengers is not a crime. Patting someone down is not a crime. Too many people are really lame and do not understand that EVERYONE must be screened and checked. The first time you decide to start allowing kids to not be screened or old ladies - the terrorists will use them to slide weapons or bombs past security checkpoints.

This is real basic stuff, but too many politicians and simple minded people don't understand reality.

Sure, it would be nice if the TSA could just ask politely if you were a terrorist or not and then let you go along your way. Keep dreaming about your fantasy world.

The first time some nut job blows up a plane with your grandmother in it you will be shouting that the government failed to protect us.

No one forces you to submit to the TSA security check. They do not restrain you and conduct a search.

You have the option of a machine scan or a "pat down"search.

You also have the option of NOT flying. There is no constitutional right to fly.Airlines are private services that are regulated by the federal government.

There already are "check points" POEs(port of entry). You and your vehicle can be "inspected". While riding on a commercial bus(greyhound, etc) you and your baggage can be subjected to search by drug dogs.Trucking is subject to random searches of the vehicle and the drivers person and possessions.

When people cannot be trusted to conduct themselves in a manner that doesn't pose a threat to others the government is bound to enact measures to protect the public welfare.

You can't have it both ways.

I am a breast cancer survivor and as a result I have one boob which is bigger than the other. I went through 16 weeks of chemotherapy every other week and I went through 7 weeks of radiation therapy every day for 7 weeks.

I am not in the mood for someone to radiate me any more, only to then pull me aside and feel me up to make sure my bigger boob is not hiding a bomb. Its totally ridiculous. Want to see my scars? This is not something I choose to share with a lot of people.

There is nowhere I want to be badly enough to go through that sort of humiliation.

For some reason, its gotten worse. After my ordeal, my husband and I flew from US to Portugal, got on a cruise ship and traveled all around. France, Spain, Italy, Malta, Turkey, Greece. It was wonderful. At no point did anyone say they needed an x-ray or they needed to feel me up.

    This is just idiotic.

If anyone is interested, feel free to quote me or tweet what I've said. Take it out of context, I don't care. The point needs to be made and I'm totally with the Gandhi and Martin Luther King attitude, which is how about if we just boycott the airlines? Not only are they feeling up our entire bodies, but they just made about a bazilion dollars this past year off the extra charges for our luggage which they go through and search and mess up completely.

Some say that you should know you are giving up your rights when you buy the ticket. Though I don't see anywhere on the TSA website that they may give you no option but to either be photographed in a way that would be illegal to photograph a minor, or that they must molest you in a way that would make you a sexual offender if you touched someone on the street like that.

It's like if you walked into my house and I said, now you have to submit to my security check, which you inherently agreed to by walking through my door (with no written notice) and I get to photograph you naked, or touch you genitals, and if you want to opt out of either, you could be subject to a $10,000 fine if I feel like it.

We are losing rights every single day. Even if you choose to drive instead of fly your rights will be demolished by state highway patrols. What ever happened to the 4th amendment? I hate stoners and believe that druggies and hippies should be murdered on the spot. But honest, hard working, brave Americans should not have their fourth amendment rights violated in every possible way. It pisses me off to no end! I will change this!!!
