How much do I have to change my group's name for it to be legal?

My problem is with names for my group. I started using one but realized that it was already in use somewhere else. The one I used is The Brotherhood of Freedom with the "the" as part of it and I don't believe the others do have "the" in theirs, so would that make me change mine still? Also I was wondering if it would be legal to change mine to The American Brotherhood of Freedom if that "the" isn't enough? Or is that still too close? I would really like some kind of professional advice.

    Well, its all about the likelihood of confusion. Just adding the The isn't enough if its a group you could be confused with. It has to be different enough that there is absolutely no likelihood of confusion.

    maybe change brotherhood to brothers or freedom to independence
