Roms are illegal unless you have a hard (e.g original) copy of said game. emulators themselves however are not illegal as they're just a program that emulates said machine and game using the info from the rom. it's the copyrighted data/information on the Roms that makes them illegal.
on a side note... companies arent generally that concerned with roms of old games for unsupported systems (as theres currently no market for them, and no money being generated based on older platforms) I would definitely not suggest downloading roms of the more recent systems (like Nintendo DS for instance) if you're that concerned about being caught.
personally I've got just about every rom to be known from the 16 bit and prior days on an original modded xbox, and I'm yet to have any issues.

No sir you can not get in trouble!
Although it might be an issue if your the one uploading the emulator/rom documents/files.
