I'm being threatened to be sued for listing a fake Rolex on ebay. Any legal advise?

I recently listed a fake Rolex on Ebay. I bought it for $2.00 at a garage sale and listed it for $39.99 after putting a new battery in it. Ebay pulled the listing and told me I was in violation and not to list it again. I had no idea that listing this for sale was illegal. Now I get an email today from some lawyers in New York making several demands on me, one of which is to send them $350.00 for their legal fees.I'm disabled and barely survive on a monthly disability check. I can't afford to hire an attorney and I can't afford to pay these bloodsuckers what they are demanding of me. I'm asking for any legal advise I can get. Thanks!

    Sorry Bloodsuckers?

    Are you seriously complaining?

You knew beyond doubt that the 'Rolex' you bought was fake. You MUST know it is illegal to sell fake merchandise.

You have just been caught, that's all.

You have done something illegal, and are now being served.

If you cannot afford to pay, then write to the lawyers explaining this was an honest mistake and you cannot pay. Explain your circumstances.

If they insist you will pay, then tell them they will have to sue you. If it goes to court then you will have to explain the whole thing to a judge and hope he accepts that you are a bit dumb.

The best case scenario is that the lawyers decide it is not worth the hassle of going to court.

it could all be fake. You never know if I were you I'd contact the person who sent you the email, and get on the phone with an actual human, and try to explain to them it was an accident some how. There's a lot of scam artist who do the same thing than you'll send them whatever amount of money they asked for and now you're out 350$ look into it before sending any money at all.

Who are these people? By what authority are they attempting to bill you for $350? Did someone end up buying your fake watch? From what you describe, it sounds like these people are just sending you a bill to see if you'll pay. You might want to consider sending an inquiry to the New York district attorney's office and let them investigate it.

Let me get this straight..... You listed a fake Rolex on eBay, and you say you did not know it was illegal? That was an expensive lesson. If customs got wind of it, the fine is $50,000.

If you offered up illegal drugs on eBay, expect roughly the same.
