Can Hospitals make a spouse liable for a patient who died there?

A friend passed away in the ER recently. She had Medicare Part A only. The Hospital is now sending the bills to the address and harassing her husband for the balance.

I could use any advice or sources for advice.

Also, this was in California.

Medicare Part A is for hospital services. The bill is probably for the 20% of the doctor and hospital costs that Medicare does NOT cover.

The account will go to collection and they will try to collect from him. If she stated on the paperwork that her husband is responsible for the bills, they can collect from him.

Why wouldnt he want to pay for his wife's treatment?

I don't know if a spouse is legally liable. Sorry I cant answer.

If no one paid the hospital bill... probably. Someone needs to pay even if the patient died.

Yes they can, however simply talking to the hospital and explaining the situation can often lead to a reduced charge.

  • ?? Of course. The spouse is ALWAYS responsible for unsecured debts.
