Will the eviction show up on backround check?
Will an eviction show up on an eviction check when applying for an apartment if you never had to go to court for it and you owe no money. We got out of the apartment before it went to court.
The landlord said that if we were out by a certain day that they would not take us to court. Isn't that how evictions are found out about is by court records?
I checked credit report 5 months afterward and there was nothing about an eviction on there...am I safe if they hadn't filed it by then?

It is on your credit report if the landlord filed. Going to court is not required for reporting.

No landlords do NOT just search court records and YES they can still find out about it. Only lazy landlords do a basic records search. Those are one ones that repeatedly get bad tenants because they don't do a good enough background check. Most landlords will and should call at least 2 yrs of rental history. We do this because there are things like this that you cannot find out in a basic records search. A basic search will not tell a landlord how dirty or clean you left the place or how many times you were late with the rent. We have to talk to each other to find out these things.

Normally if you fail to go to court, you would lose by default. It matters not that you left the rental unit prior to the court date. You should have appeared in court and informed the judge that you were no longer in the rental unit..
Since you decided not to attend your court hearing to inform the judge you had departed he had no choice except to find you guilty by default. Therefore the eviction should appear on your credit report approximately 15-30 days after the court date.
If the landlord failed to go to court then the judge will dismiss the entire lawsuit, therefore an eviction would not appear on your credit report.
You could still be sued by the landlord for past due rent or damage to the rental unit in small claims court if the landlord so desire.

Yes, vacating the property before court does not stop any action the landlord was taking against you.
